No.18 THE ENVIRONMENT AGENCY COMING TO BURNISTON BUT DROPPING THEIR PLANNING OBJECTION!!

The situation in Burniston is that NYC have still to decide on the planning application and at the same time Europa have applied for various licenses to the Environment Agency. The EA's closing date for objections is 19th September 2025.

The Environment Agency sent a letter to Burniston Parish Council to confirm their consultation dates and to say they will be holding a drop in session in Burniston and Cloughton Village Hall on 3rd September from 12 to 4pm. Please find the notice here. The environment agency asked BPC to share this information.

In the meantime, Drill or Drop have reported 'Regulator drops objection to Burniston gas drilling and fracking'. The Environment Agency told Drill Or Drop that 'it no longer recommends refusal of the planning application from Europa Oil & Gas Limited. A written record of the EA’s new view of the application has not yet been published.' Many people are, understandably, very worried about this turn of events with no explanation, and would dearly like to know what went on behind the scenes to change the mind of such an influential consultee. The reason for the change does not appear on the public planning portal so it is not at all transparent to the public.

BEACH FUN - ALL IN A GOOD CAUSE - THE FINAL EDITED VIDEO TO SHARE

All this news is a bit heavy, so one early morning we and some supporters went to Scarborough South Bay. A beach artist drew a life size drilling rig next to a double decker bus - with a line of people lying down end to end from top to bottom. There was just enough room at low tide to do it although some people got a bit soggy! This video is amazing and shows the whole thing in time lapse. Please share the video to bring awareness to our cause and for people to sign and share the petition. We are almost up to 10,000 signatures. At 10,000 the government will respond to our petition. At 100,000 votes we get a debate in parliament. There is no surer way to beat the frackers than to ban fracking altogether by law.

PLANNING APPLICATION AND ENVIRONMENT AGENCY OBJECTIONS UPDATE

NYC are still accepting objections to the planning application but time is running short. You will see there is what is described as 'permission creep' in the EA application. For example Europa are asking the EA for FOUR proppant squeeze operations and burn more than 10t of gas from the flare PER DAY - BUT they have only asked for one proppant squeeze operation in the planning application. Therefore there will be more waste, HGV's time the flare is active etc than was revealed to NYC. There are also many missing documents.  You can still object to and view other comments on the planning application here (go to documents and click on 'Comment on this application').

You can also comment on the EA application for permits - the closing date for this is 19th September. Frack Free Coastal Communities will be sending out a summary of what you could object to shortly. And dont forget the drop in session on the 3rd September (see above).

WE NEED SOME HELP.

1) We would like to hear from anyone with specialist knowledge of industrial waste categories. For example the thresholds that would define 'Category A' in the Mining Waste Directives - especially where the waste is toxic, liquid and to be stored underground.

2) We would like some input from locals in the area to check if the lists of special receptors in the  EA applications. We have found many missing receptors (residential, designated sites etc) and could do with some help to identify all or most of them. In the EA application receptors are listed in the following documents:

  • Application Bespoke A001 05 Waste Management Plan Page 17

  • Application Bespoke A001 06 Site Condition Report Page 15 (5.2 and 5.3), Page 23 (6.2)

  • Application Bespoke A001 07a Environmental Risk Assessment Table on page 3 (statutory and designated receptors), table on page 5 (sensitive receptors), table page 8 (Statutory and Designated Water Receptors),

3) Missing surface water items in the following

  • Application Bespoke A001 07a Environmental Risk Assessment (table on page 6)

  • ZG-EOG-CLTN-EPR-04-08 Extent of Mining Waste Facility Plan 10000 Scale A3

REMINDERS OF WHAT WE ARE FIGHTING AGAINST

We all know what devastation will occur around the drill site. But did you know within the EA application is a map showing where Europa are applying to leave toxic waste in the ground - for ever. The map is called ZG-EOG-CLTN-EPR-04-08 Extent of Mining Waste Facility Plan 10000 Scale A3. I dont think the people of Scalby would be happy with the location and the problem is they would never know unless it is pointed out to them as it is very far from the drill site.
